Insufficient evidence means charges stayed for Alberta man involved in fatal N.B. crash

The case of an Alberta man charged with impaired driving causing death will not proceed in court due to insufficient evidence.

Harold Weiss, 64, of Barrhead, Alta. was charged after a deadly crash on Feb. 23 in which a semi truck slammed into an SUV at the intersection of Highway 40 and Highway 16 in North Battleford. The semi truck drove through the centre guardrail into oncoming traffic, hitting an SUV stopped at a red light. The driver and lone occupant of the SUV, whose name was not released, was killed instantly. 

Weiss did not appear in court today, June 28, but his charges of impaired driving causing death and dangerous driving causing death were stayed by the Crown. Prosecutors do not intend to move forward, but indicate the stay could be lifted in the future.

Crown prosecutor Tanner Daniels said results of Weiss’s toxicology report indicated there weren’t any drugs in his system at the time of the crash. Daniels added there was insufficient evidence to suggest Weiss drove dangerously. Crown was unable to rule out medical distress as a factor in the collision.
